CONSENT TO TERMS AND CONDITIONS
Access to and use of the services of Worldly Dream Travel LLC, dba Dream Mickey Travel (“Worldly Dream Travel LLC” “the agency” and/or “our”), Independent Contractor Travel Agents associated with the agency, and our website, social media or other reference materials is subject to acceptance of these terms and conditions (“Terms and Conditions”). By accessing, using or obtaining any content, products, or services through our agency, independent Travel Agents, through our website/social media, or any of our platforms or documents, you, the purchaser (“Customer” “Client”, “passenger”, “guest and “you/your”) and others for whom you are acting collectively (“passenger(s)” and other minors/adults who you are booking travel for) agree to be bound by these terms. PLEASE READ THE TERMS BEFORE BOOKING, USING OUR WEBSITE, ACCESSING OUR SOCIAL MEDIA, OR ANY OF OUR REFERENCE MATERIALS. These terms and conditions govern the relationship between Worldly Dream Travel LLC and you, the Client. These terms restrict your rights and remedies and provide protection to Worldly Dream Travel LLC. These also include warranty disclaimers and liability exclusions. By booking travel, paying your deposit, using/viewing the agency website or any of our reference materials, you acknowledge and agree (a) this is a fair balance because this website and our materials is accessible by you conveniently and at no charge; (b) by paying a deposit and booking a trip you agree that you have read and agreed to our terms and conditions and any supplier/travel service provider terms and conditions, legal entry requirements for your destination, travel documentation required for your destination, and (b) if you do not agree or do not accept these Terms and Conditions, you can choose to not use the services, suppliers, website, social media, or materials provided by Worldly Dream Travel LLC. If there is anything is in these Terms and Conditions, including warranty disclaimers and liability exclusions, that you disagree with or are not willing to be bound by, or if something is missing from these Terms and Conditions that you consider essential, then you must not use our services. IF THERE IS ANY PART OF THESE TERMS AND CONDITIONS YOU DO NOT AGREE WITH, PLEASE DO NOT USE THIS WEBSITE OR WORLDLY DREAM TRAVEL LLC’S SERVICES. No alterations to these terms and conditions may be made by any WORLDLY DREAM TRAVEL LLC employee, authorized representative, independent travel agent, client, or associate, unless permitted in writing by the authorized owner of WORLDLY DREAM TRAVEL LLC.
RESERVATION OF RIGHTS: CHANGES TO THESE TERMS
We reserve the right, in our sole discretion, to change these Terms at any time. Updated versions of the Terms will be posted on the website and are effective immediately on posting. Please check frequently to see if these Terms changed. Continuing to hold a booking with Worldly Dream Travel LLC or use of the agency’s social media platforms, reference materials, documents or website after any changes to the Terms constitutes your consent to the changes. You may discontinue use of websites/social media/materials at any time. You may cancel your bookings at any time due to disagreement with updates to the terms and conditions. Cancellations will be subject to any and all fees/penalties imposed by suppliers and/or Worldly Dream Travel LLC.
USE OF WORLDLY DREAM TRAVEL LLC ACCESS AND INFORMATION FOR TRAVEL BOOKINGS
You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to make travel bookings with Worldly Dream Travel LLC by any means in accordance with all terms and conditions herein. You agree to be financially responsible for all of your travel bookings (as well as for use of your account by others, including, without limitation, minors living with you or adults and minors traveling as passengers on reservations that you have booked). You agree to supervise all usage of Worldly Dream Travel LLC communications by minors under your name, booked under your reservations, or on your account. You also warrant that all information supplied by you or members of your travel party transacting business with Worldly Dream Travel LLC is true and accurate. Without limitation, any speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited. You agree that the travel services, reservations, media, and facilities provided by Worldly Dream Travel LLC shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act. If you are listed as the lead guest on any reservation booked through Worldly Dream Travel LLC, you are acting as the representative of all other guests listed on the reservation and accept responsibility for their participation in all bookings financially and physically traveling.
Separate supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. You agree that you and your entire travel party will abide by the terms and conditions of purchase imposed by Worldly Dream Travel LLC and any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. You understand that any violation of any such supplier’s conditions of purchase may result in cancellation of your reservation(s) or purchase, and your being denied access to any flights, hotels, cruises, or automobiles, or other services you have reserved. You agree that violation of any supplier’s terms of service may result in your forfeiting any monies paid for such reservation(s) or purchase. You agree to Worldly Dream Travel LLC debiting your account immediately for any costs that Worldly Dream Travel LLC incurs as a result of such violation. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through access provided by Worldly Dream Travel LLC.
QUOTES AND BOOKINGS
Your independent travel agent representing Worldly Dream Travel LLC will work with you to price the supplier, location, and any additional components of your choice. When you receive any and all travel documents, it is the sole responsibility of YOU, the Client to review and verify that all information is correct including but not limited to: travel dates, travel destination, Hotel/resort confirmations, travel package confirmations, tickets, transportation, tours, excursions, flights, passenger names, dates of birth, identification, etc. Contact your independent travel agent immediately if changes or corrections are required. You must ensure that each traveler’s name and date of birth is correct and that the components of the trip are booked correctly. If there are any discrepancies or incorrect information you are required to notify your independent travel agent within 24 hours of receiving the quote. The independent agent will revise/update the information at that time and send you a modified quote. When you are satisfied that all the information on your travel quote is correct, then the independent agent will proceed with collecting your deposit/payment. Please note: Pricing is subject to change without notice until a deposit is secured and booking is confirmed by each supplier. By making a payment toward your quote, you certify that all the information for supplier, location, dates, additional travel components, and all passenger information on the trip is correct. Some suppliers do not allow changes after booking or they charge fees for changes after booking. Client is responsible for any change fees after the deposit is made for any booking. By making a deposit you confirm that you have read, understand, and agree to any supplier requirements, contracts of carriage, supplier/agency cancellation policies, health requirements, and/or entry requirements for your travel destination.
RIGHT TO CORRECT ERRORS/OFFERS SUBJECT TO AVAILABILITY
We reserve the right to correct errors. All travel offers are subject to availability and may change without notice. In the event of a pricing error or omission, we reserve the right to adjust such pricing or make any other corrections.
ACCESSIBILITY ACCOMMODATIONS
If you or anyone in your travel party need to request accommodations for a disability or have requirements for health/physical/mental ability, please notify your Independent Travel Agent during the initial consultation. Your Independent Travel Agent will assist in notifying suppliers of accommodations needed. Please note that not all suppliers are able to make accommodations in every situation. Please make sure to discuss all needs with your independent travel agent.
TRAVEL DOCUMENTS
It is the responsibility of each Client to obtain and carry a valid passport, visa(s), vaccines, and all other documents required by applicable government regulations.
Clients are required to obtain any required visas to enter some international destinations. It is the responsibility of the client to research and understand if they do or do not qualify for a visa for their travel destination. Worldly Dream Travel LLC neither controls nor warrants the issuance of visas related to applicable travel. Should a visa not be issued, Worldly Dream Travel LLC is not responsible for lost payments made toward the proposed trip.
When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight. Acceptable identification can be found at http://www.tsa.gov/traveler-information/acceptable-ids. The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on airline ticket(s) and booking records. Worldly Dream Travel LLC strongly recommends that you consider that certain countries will not admit, and some transportation carriers may deny boarding a passenger, if their passport expires within six (6) months of the date of entry. Non-United States citizens may require additional documentation. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities. The U.S. Customs and Border Protection Agency requires that for USA child groups under age 19 arriving by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent must be provided to the supervising adult/Group Leader. You acknowledge any failure to strictly comply with these requirements may result in denied admittance or boarding or an undue delay at security checkpoints causing Client to miss flight(s), and/or subsequent scheduled travel bookings on cruises and tours. Check each supplier’s website to ensure you and all members in your travel group or party obtain and carry travel documentation required. Worldly Dream Travel LLC is not liable for any losses, delays, cancelations, or denials due to passengers not having the correct travel documents or identification.
ENTRY AND EXIT REQUIREMENTS
Worldly Dream Travel LLC offers various international destinations through our supplier network. These destinations have specific requirements for entry. This includes but is not limited to: passport, visas, vaccinations, criminal background checks, etc. Again, these documents are your responsibility and the agency cannot be held responsible for denial of exit or entry from any country.
International travel requires the use of a Passport Book. It is the responsibility of the Client to make sure that everyone listed on the booking confirmation(s) have the required immigration paperwork for entering and exiting the destination country. (Passport cards are not accepted for air travel.) Immigration documents/requirements vary among countries. Each foreign country has various entry requirements that may include obtaining a visa, identification requirements, health requirements, and background checks. If you do not have a current passport, please make note of the processing times when you are planning your itinerary. You will need to give yourself enough time to gather the documentation required to obtain a passport, get an appointment to apply for the passport, and get the passport shipped to you. If your destination requires a Visa to travel, you will have to wait for the passport to be processed before applying for the Visa. Worldly Dream Travel LLC is not responsible for any losses, delays, cancellations, or denials due to travelers not obtaining all of the appropriate immigration paperwork, passports, or health requirements in a timely manner for travel.
Travel destinations and/or specific locations may have specific requirements for entry which can include specific vaccinations, face mask requirements, or other health requirements. It is the responsibility of each passenger to research, understand, and comply with the health requirements of their destination. If your destination requires vaccinations or additional health documentation, you will need to allow enough time to get all items completed before traveling.
Each guest is responsible to make absolutely certain to have the proper immunizations and required documentation of such immunizations before travel, and to make the necessary accommodation for security rules imposed by government authorities. Worldly Dream Travel LLC shall not assume responsibility for the accuracy of health requirements or vaccination and/or documentation prior to departure or upon landing at the final destination. See your health practitioner for advice. Prior to travel, required inoculations, if any, must be recorded by Guest’s health practitioner on a valid vaccination certificate, which the Guest must carry for proof of inoculation where required. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Worldly Dream Travel LLC is not liable for cancellations, delays, or denial of entry due to noncompliance with health requirements.
CRIMINAL RECORDS
Every country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact your attorney and that country directly for entry and exit requirements. It is the Guest’s responsibility to research, understand, and comply with the laws of their destination. We feel it is an invasion of privacy for any agent or associate of the agency to inquire about this information from clients. Worldly Dream Travel LLC is not liable for denial of entry to supplier or location due to a past criminal offense. We strongly recommend that if you or anyone for whom you are acting have a criminal record; that you ensure that you will be allowed entry prior to making a deposit for a trip. Guest is responsible for any cancellation fees and/or penalties and accommodations for their return if denied entry and/or passage due to a past criminal record.
CONTRABAND
Domestic and International destinations may have laws that prohibit certain items including but not limited to alcohol, medications including over the counter/prescription meds, legal/illegal drugs and paraphernalia, chemicals, clothing, cultural artifacts, firearms/ammunition, fish and wildlife, food products, knives, pets, plants/seeds, soil, agricultural products, etc. The United States has entry requirements for returning with certain items. Guests are responsible for researching and understanding the laws, regulations, and requirements and what is legal and illegal for traveling domestically or entering international destinations and/or returning to the United States. Worldly Dream Travel LLC Independent Travel Agents and Employees are unable to provide legal advice or assistance regarding Customs laws and prohibited items. Guest is responsible for any items that they carry during travel and any losses, delays, or legal issues encountered during their travel.
PETS AND SERVICE ANIMALS
You are required to notify your Independent Travel Agent if you will be traveling with your pet or a service animal so they can notate your reservation. Please note that not all suppliers allow pets. Clients are required to research and understand all laws and requirements for entering their destination with a pet. This can include but is not limited to: vaccinations, vaccine titers, age requirements, quarantine requirements, health certificates, import permits, and breed restrictions. For service animal handlers, not all countries have public access laws and you may not be able to enter some areas with your service dog. Some countries have breed restrictions. It is the client's responsibility to be familiar with the public access laws of their destination. Clients with service animals agree that their animal is a legal, task trained service animals and that they are not misrepresenting a pet or emotional support animals. Worldly Dream Travel LLC does not warrant that pets or service animals are allowed or disallowed in any destination and is not liable for any losses or delays due to not having the appropriate documentation for pet travel. RISKS/SAFETY
Travel to certain destinations may involve greater risk than others. Worldly Dream Travel LLC urges clients to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, and http://www.cbp.gov The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/
Exposure to pathogens (such as the virus that causes COVID-19) is an inherent risk in places where people gather and may result in severe illness or death. Exposure to various pathogens may occur at any point during travel. Preventative measures taken by passengers (Such as handwashing and wearing facemasks) can help mitigate the risk of exposure but cannot eliminate it entirely. Before booking or traveling, all guests should consider their individual risk level for severe illness resulting from pathogen exposure and make an informed travel decision on that basis. We recommend guests with a higher risk of severe illness consult with their doctor prior to booking or traveling. There can be various physical, mental, and health hazards for travel excursions, tickets, activities, and modes of transportation during travel. Worldly Dream Travel LLC will book these items for clients per their request. There are too many variables, and each passenger is responsible for considering the risks to all aspects of travel and any activities booked.
BY OFFERING TO BOOK AND SELL TRAVEL FOR CLIENTS TO PARTICULAR DESTINATIONS EXCURSIONS, ACTIVITIES, TICKETS, OR MODES OF TRANSPORTATION, WORLDLY DREAM TRAVEL LLC DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS OR ACTIVITIES/EXCURSIONS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, DELAYS, LOSSES, INJURY OR DEATH THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS OR ANY PORTION OF TRAVEL BOOKED UNDER THE AGENCY INCLUDED BUT NOT LIMITED TO: ACTIVITIES, EVENTS, MODES OF TRAVEL ETC. CLIENT’S BOOKING AND PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CLIENT’S OWN RISK.
TRAVEL RESOURCES
For further information relating to security, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), and re-entry into the United States visit www.tsa.gov, www.dot.gov, www.faa.gov.us, www.ustreas.gov, www.cbp.gov, on a regular basis for information regarding incidence of disease, terrorism, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), and re-entry into the United States especially your embassy and http://www.uscis.gov/ for non-USA citizens. (Client is responsible to make Worldly Dream Travel LLC aware when traveling on a passport from a country other than the USA). Please note that USA rules regarding entry and exit change on a daily basis. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification found http://www.tsa.gov/traveler-information/acceptable-ids. . Examples: DHS-designated enhanced driver’s license, USA Passport, a foreign government passport.
PAYMENTS, CANCELLATIONS, AND REFUNDS
Unless otherwise defined during the reservation process, final payment is due prior to departure or consumption according to each supplier’s (airline, hotel, cruise line, transfer company, sightseeing operators, and other travel service vendors) terms and conditions involved in your travel booking. It is the client’s responsibility to note final payment dates and plan accordingly. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. Worldly Dream Travel LLC is not responsible for missed payment dates due to lack of response by client. Suppliers may have payment cut off times of noon, 5pm etc. It is the client’s responsibility to take this into consideration. If a final payment is missed there may be cancellation fees and/or loss of deposit. If a booking can be reinstated, pricing my change or there may be fees to reinstate the reservation. Worldly Dream Travel LLC is not liable for pricing changes or losses due to missed final payments.
Worldly Dream Travel LLC pays suppliers directly on behalf of clients. A credit card is required to make transactions for supplier payment. Worldly Dream Travel LLC does not accept payments from clients directly. Independent Travel Agents will make payments directly into the supplier booking system using the credit card provided by the client. By providing your credit card information you agree to the processing of the payment on your behalf. Clients are responsible for any foreign transaction fees that occur for making payments to suppliers for their booking. By booking with Worldly Dream Travel LLC, you agree to provide valid credit card information with a credit card that is issued to you, the guest listed on the reservation.
Each supplier has their refund in their terms and conditions. It is the client’s responsibility to review and understand the cancellation policies prior to booking. When you put a deposit and/or pay for travel through the agency, you are agreeing to the supplier and agency cancellation terms and conditions. In some cases, there is NO REFUND once a booking is made and paid for. Some deposits are nonrefundable. Some suppliers have tiers for their refunds based on booking and travel dates. If your trip includes multiple suppliers, there may be different cancellation policies for each supplier. Your right to a refund if you change or cancel your travel plans is limited. All cancellation requests must be sent to your Independent Worldly Dream Travel LLC Travel Agent in writing. As a result of cancellation, Worldly Dream Travel LLC and all supplier’s cancellation penalties will apply, which are detailed in your travel documentation, each supplier’s website. Worldly Dream Travel LLC cancellation penalties are advised at time of booking and provided to you upon confirmation. If you have any questions, please contact your Worldly Dream Travel LLC Independent Travel Agent. All cancellation fees will be charged to the credit card you authorized to pay for travel services or deducted from the supplier’s refund. By making a deposit on a trip, you agree that you have read and understand all cancellation policies for your supplier reservation(s).
All refunds or future credits are processed by each individual supplier. In most instances refunds are processed back to the original form of payment. If a client is using gift cards to pay any portion of travel, we recommend that you keep those original gift cards until after travel is completed. If you do not keep the original gift cards, you may not have access to the refund that is processed back to the card. Your Independent Travel Agent will contact the suppliers for estimates on refund timelines. Note that some suppliers take 90+ days to process refunds. Neither your Independent Travel Agent nor the Agency has any control over how long it takes a supplier to process your refund.
If for any reason, any Travel Supplier is unable to provide the services for which you have contracted, your remedy lies against the supplier, and not against Worldly Dream Travel LLC. You agree to waive the right to legal action against Worldly Dream Travel LLC for any dispute that has to do with any supplier, including but not limited to; supplier terms and conditions, dissatisfaction with supplier, refund processing times, cancellation policies, or lack of service. You agree that you will not institute a credit card dispute or a “charge back” for any booking made to a supplier through Worldly Dream Travel LLC. If the credit card is passed through to the Travel Supplier through Worldly Dream Travel LLC, and you open a dispute or chargeback, your payment from any travel supplier or service booked through the agency, you agree to be held liable without limitation to reimburse the agency immediately for any and all costs and/or damages to the agency associated with the dispute or chargeback. These costs can be including but not limited to air debit memos, all costs charged by the supplier to the agency for the chargeback/dispute, bank fees, attorneys’ fees to recover any payments charged back by your credit card company. If the credit card is declined, you guarantee that you will settle any amounts owed to the supplier or Worldly Dream Travel LLC immediately.
TRAVEL INSURANCE
TRAVEL INSURANCE IS RECOMMENDED TO PROTECT PASSENGERS AND THEIR INVESTMENT. UNLESS SPECIFICALLY NOTED, TRAVEL INSURANCE IS NOT INCLUDED IN THE COST OF CLIENT’S ITINERARY TO PROTECT AGAINST THIRD PARTY SUPPLIER DEFAULT/BANKRUPTCY PROTECTION, DELAY, INTERRUPTION, MISSED CONNECTION FOR CRUISES, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION/EVACUATION & REPATRIATION, BAGGAGE & PERSONAL EFFECTS/LOST LUGGAGE & BAGGAGE DELAY, ILLNESS, JOB LOSS PROTECTION AND CHANGE OF PLANS, ACCIDENTAL DEATH AND DISABILITY, TRAVEL ACCIDENT/SICKNESS MEDICAL EXPENSES, AND MORE. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES. An additional charge applies for travel insurance selected. Travel insurance can be purchased through travel suppliers or separately. Without appropriate travel insurance, Client understands and agrees that if Client cancels or interrupts Client’s travel for any reason, portions of the trip/tour may not be refunded and Worldly Dream Travel LLC’s and Travel Suppliers’ cancellation penalties will apply resulting in the loss of monies up to the full cost of Client’s travel booking and related costs. Client understands and agrees that their health insurance may not cover anything while traveling abroad. Client will be fully responsible for any costs related to accident, illness, evacuation etc. The purchase of travel insurance is not required to purchase any other product or service offered by Worldly Dream Travel LLC. Independent Travel Agents or employees of Worldly Dream Travel LLC are not qualified or authorized to: answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage. If a Client places a deposit or pays for travel without insurance on their booking, Client agrees to inherit the risk of traveling without insurance. Worldly Dream Travel LLC is not responsible for losses, damages, delays, penalties, or health risks to clients who choose to travel without insurance.
GRATUITIES AND ADDITIONAL FEES
Wherever possible, your Independent Travel Agent will attempt to inform you of any additional costs that you might incur. Worldly Dream Travel LLC is not responsible for any omissions of additional fees during the quote process. These types of fees include but are not limited to: Gratuities to guides, hotel staff, or drivers, mandatory onboard service charges/gratuities for cruises, city taxes payable directly at the hotel, costs for transport to/from the airport if traveler did not include transfers in quote, meals, beverages, resort fees, parking fees, etc. Worldly Dream Travel LLC is not responsible for any increases due to fuel surcharges, government-imposed taxes/fees or supplier-imposed increases.
FORCE MAJEURE
“Force Majeure” means, in relation to Worldly Dream Travel LLC, any circumstances beyond the reasonable control of Worldly Dream Travel LLC and the Agency’s Independent Travel Agents and employees, (including, but without limitation, acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences).
Worldly Dream Travel LLC and the Agency’s Independent Contractors, employees and their heirs, travel suppliers, and associates shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.
If Worldly Dream Travel LLC, and/or any of its Travel Suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by Worldly Dream Travel LLC to you because of the non-performance of any obligations hereunder shall remain in its sole and absolute discretion, although Worldly Dream Travel LLC shall use its reasonable efforts to reimburse you where possible. However, Worldly Dream Travel LLC shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to Worldly Dream Travel LLC of the Force Majeure and applicable cancellation fees.
Regarding without limitation known or unknown civil unrest, war, pandemic, weather events, et cetera, it is the sole and absolute discretion of passengers whether to proceed with the trip. If passengers choose to continue with any trip, they accept responsibility for their decision. Worldly Dream Travel LLC is not liable for any losses or damages incurred by clients during their travel.
AIRLINE RESERVATIONS
UNLESS SET FORTH IN WRITING, AIRLINE RESERVATIONS ARE NOT INCLUDED IN YOUR TRAVEL PLANS. In such event, it is the Client’s responsibility to make appropriate air arrangements, as well as transportation to and from the destination where the travel booking originates and returns. Worldly Dream Travel LLC shall not assume any responsibility for any air and/or ground schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only, and may vary in price. Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares.
USA federal law prohibits passengers from bringing hazardous materials on the aircraft. (1) USA federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radio- active materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. (2) There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary. LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE
Worldly Dream Travel LLC acts solely as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services (“supplier(s)”), and is not the source or provider of the travel services. Each of these supplier companies is an independent entity with its own management and is not subject to the control of Worldly Dream Travel LLC. Client is advised that the suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and consents to the use of those suppliers, and understands and agrees each supplier’s Terms and Conditions are contained in printed form and are set forth on their respective websites, which govern the transaction. All bookings are accepted by Worldly Dream Travel LLC as agent for the Travel Suppliers on your itinerary. The transportation, accommodations and other services provided by the identified sea, ground, and air operator suppliers offered are subject to the terms and conditions contained in the tickets, exchange orders or vouchers issued by them and/or their suppliers, including Terms and Conditions on their respective webites. BECAUSE WORLDLY DREAM TRAVEL LLC ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS, AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE WORLDLY DREAM TRAVEL LLC IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. WORLDLY DREAM TRAVEL LLC HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES, IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH WORLDLY DREAM TRAVEL LLC INDEPENDENT AGENTS, EMPLOYEES OR THROUGH ANY WEBSITE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, FUEL INCREASES, AND OTHER MATTERS OUTSIDE OF WORLDLY DREAM TRAVEL LLC’s CONTROL, AND YOU HEREBY EXONERATE WORLDLY DREAM TRAVEL LLC FROM ANY LIABILITY WITH RESPECT TO THE SAME. Weather conditions, including but not limited to the presence or absence of snow, sunshine, and rainfall are not guaranteed to occur or not occur, and are clearly outside of Worldly Dream Travel LLC’s control. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by suppliers and your travel insurance company, which is beyond the control of Worldly Dream Travel LLC. Worldly Dream Travel LLC reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary, and to refuse to accept or to retain as a member of any tour any person at any time. Worldly Dream Travel LLC shall not assume any responsibility for any air and/or ground schedule changes. Worldly Dream Travel LLC has solely received commission and fees for travel transactions and Client agrees and understands that any recovery from Worldly Dream Travel LLC will be limited to the commission and fees paid by Client received by Worldly Dream Travel LLC for each respective trip.
GENERAL
The laws of the State of Tennessee, USA, govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of courts in Davidson County, Tennessee, USA, in all disputes arising out of or relating to travel bookings with Worldly Dream Travel LLC, including the use of the Worldly Dream Travel LLC website or materials. Use of the Worldly Dream Travel LLC website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.
If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.
These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the Client and Worldly Dream Travel LLC with respect to travel bookings made with Worldly Dream Travel LLC by any means accessing such information, including its website, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Client and Worldly Dream Travel LLC with respect to communications with Worldly Dream Travel LLC, including the Worldly Dream Travel LLC website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Any rights not expressly granted herein are reserved. These terms and conditions are effective as of July 1, 2024.
